1. About these terms
These terms are for Twinpeaks Investment [CONFIRM: full registered legal form and company number], the operator of the SurePlace platform ("SurePlace", "we", "us"). They apply when you access or use the SurePlace website, applications and related services (the "Platform"). By using the Platform, you agree to these terms. If you do not agree, do not use it.

2. What SurePlace does
SurePlace provides tools to discover property listings, accommodation and property professionals, and to communicate with listing providers. Unless a page expressly says otherwise, SurePlace is a marketplace and technology provider, not the owner, seller, landlord, tenant, accommodation provider, estate agent or party to a transaction between users.
Listing providers are responsible for their listings, authority to offer a property or stay, accuracy, availability, prices, terms, services and communications. You are responsible for independently checking material facts and deciding whether to proceed.
3. Eligibility and accounts
You must provide accurate information, keep your login credentials confidential and use an account you are authorised to control. You are responsible for activity under your account and must promptly tell us if you suspect unauthorised access.
You must meet the legal age and capacity requirements that apply to you. Do not create an account or submit another person’s personal information unless you have authority and a lawful basis to do so. We may ask you to verify your email or information before enabling certain features.
4. Listings and user content
You retain rights you hold in content you submit. You grant SurePlace a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt for formatting, display and distribute that content as reasonably necessary to operate, secure, promote and improve the Platform. This licence ends when the content is removed, except for copies retained for legal, safety, backup or dispute-resolution purposes.
You confirm that your listing, photographs, messages and other content are accurate to the best of your knowledge, lawful, non-misleading, and that you have the rights and permissions needed to submit and share them. Do not expose another person’s private or confidential information without authority.
5. Verification and trust information
Where shown, a verification status means SurePlace has reviewed specified evidence for the stated purpose. A badge is not a guarantee of identity beyond the checks performed, property condition, title, authority, safety, solvency, availability, performance or transaction outcome. Verification can become outdated or be withdrawn. You must make your own checks and obtain independent professional advice where appropriate.
6. Booking enquiries and payments
A booking request submitted through the Platform is a request to the provider; it is not confirmed until the provider accepts it and the Platform shows a confirmed status or the parties otherwise confirm it in writing. Check dates, room details, prices, house rules, cancellation terms and all other conditions with the provider before committing.
In the current release, SurePlace does not collect booking payments. Any payment arrangements made directly between users are their responsibility. Do not assume that a displayed price includes taxes, deposits or other charges unless the provider clearly confirms this. Never send funds until you have verified the recipient, listing and terms.
7. Messages and conduct
Use messages and enquiry features lawfully and respectfully. Do not impersonate another person, harass or threaten others, send spam or malicious content, evade a safety measure, scrape or disrupt the Platform, or use information obtained through SurePlace for an unrelated purpose. Do not use the Platform to facilitate fraud or discrimination.
8. Reporting and moderation
You may report content or conduct using the reporting features made available in the Platform. We may investigate, remove or restrict content, suspend features or accounts, and preserve or disclose information when reasonably necessary for safety, legal compliance or enforcement of these terms. Where appropriate, we may provide a reason and a way to request review.
9. Our intellectual property
SurePlace and its licensors own or license the Platform software, branding, design and materials, excluding user content. You may use the Platform for its intended personal or business purpose; you may not copy, resell, reverse engineer or commercially exploit it except where applicable law permits or we give written permission.
10. Availability and changes
We work to keep the Platform available and accurate but do not promise uninterrupted, error-free or complete service. Features may change, be suspended or be withdrawn. We may update these terms; the effective date will be shown above. For material changes, we will give notice by [REPLACE: CONFIRMED NOTICE METHOD]. Continued use after the effective date means you accept the revised terms, to the extent permitted by law.
11. Disclaimers and responsibility
To the extent permitted by law, the Platform is provided on an “as available” basis. We do not endorse or warrant user listings, users, communications, third-party services or transactions. Nothing in these terms removes consumer protections or other rights that cannot lawfully be excluded.
To the extent permitted by law, neither party is liable for indirect or consequential loss arising from use of the Platform. Any proposed cap or exclusion of liability, and any allocation of responsibility between SurePlace and users, must be reviewed and completed by Eswatini counsel before publication; this template does not create a blanket exclusion of liability.
12. Suspension and termination
You may stop using the Platform at any time and may request account closure through [REPLACE: ACCOUNT-CLOSURE METHOD]. We may suspend or terminate access for a serious or repeated breach, a safety risk, legal requirement or operational reason. We will act proportionately and provide notice or an opportunity to challenge where reasonably possible and legally appropriate. Provisions that by their nature should continue will survive termination.
13. Governing law and disputes
Proposed for legal review: these terms and disputes relating to them are governed by the laws of the Kingdom of Eswatini, without limiting mandatory rights available to consumers. Eswatini counsel must confirm the appropriate courts, consumer remedies and dispute wording before adoption. Before formal proceedings, contact support@sureplace.twinpeaksinvestment.com so we can try to resolve the concern.
14. General and contact
If a provision is unenforceable, the remaining provisions continue to apply to the extent lawful. These terms, together with policies expressly incorporated into them, describe the agreement about use of the Platform. No waiver is effective unless made in writing. You may not transfer your rights under these terms without our consent; we may transfer them as part of a lawful business reorganisation.
